Serving a section 21

This is not the most happiest of subjects and I hope that you don’t have to serve a section 21, but if you do it is so important that we do not lose our ability to remove a bad tenant without having to prove that they have done something wrong.

The biggest change is that ALL relevant documents MUST be given to EVERY TENANTS even for tenancies that began prior to October 2015 by 1st October 2018.

The documents that need to be provided are:

  • Gas Safety Certificate
  • Energy Performance Certificate
  • Government’s How to Rent Guide
  • Electric Safety Certificate (only for HMO at the moment)
  • Deposit Protection Documents (not required for SPT)

There are currently no changed at this time the documents must be provided with 30 days of taking the money and at the start of every subsequent new contract is the deposit continues to apply.

I hope that this blog will enable you to main your legal right to a ‘no fault’ eviction if you should event need one.
